These Terms and Conditions ("Terms") govern your use of our website www.inayawellness.in, products, services, and digital content (collectively referred to as the "Services"). By accessing or using our Services, you agree to be legally bound by these Terms. If you do not agree to these Terms, please do not use the Services.

You must be at least 18 years old to access or use our Services. By using our Services, you represent and warrant that you are of legal age and capable of entering into a binding contract.

 

2. Services Overview

 

Inaya Wellness offers:

 

• 1:1 nutritional and health coaching

• Custom wellness protocols

• Digital products (e.g., detox guides, recipe books, wellness challenges)

• Educational blog content and infographics  

 

All Services are for informational and educational purposes only and are not intended to diagnose, treat, or cure any medical condition.

 

3. Medical Disclaimer

 

Our Services do not constitute medical advice. While we provide guidance on nutrition, lifestyle, and wellness, the information is not a substitute for professional medical consultation. You should always seek the advice of your physician or a qualified healthcare provider before starting any new health regimen.

 

 

4. Client Responsibilities

 

When participating in 1:1 coaching or programs, clients agree to:

• Provide accurate personal, health, and medical information

• Follow mutually agreed-upon protocols and plans

• Communicate respectfully and responsibly

• Notify Inaya Wellness of any changes in health or medication

 

Inaya Wellness reserves the right to discontinue services if clients are non-compliant, abusive, or dishonest.

 

5. Intellectual Property

 

All content, designs, logos, graphics, text, images, videos, course materials, PDFs, recipes, and any other materials provided by Inaya Wellness are the exclusive intellectual property of Inaya Wellness and/or Jimit Shah. Unauthorized reproduction, distribution, modification, or resale is strictly prohibited. Violators may be subject to civil and/or criminal penalties.

 

You may not:

• Copy, share, or resell any digital product or course material

• Use our content for commercial purposes without written consent

• Claim any part of our work as your own

 

6. Payment Terms

 

All purchases made through our website are final unless explicitly stated otherwise. For coaching services, payments must be made in advance. Missed sessions without 24 hours' notice may be forfeited at our discretion.

7. Refund Policy

 

- Digital products: No refunds, unless the product was not delivered or is materially defective

- Coaching packages: Partial refunds may be considered if cancellation is made within the first 7 days of purchase and sessions have not yet commenced

 

Refund requests must be submitted in writing to connect@inayawellness.in.

 

8. Privacy and Confidentiality

 

We respect your privacy. All personal data shared with us will be handled in accordance with our Privacy Policy. Client sessions are confidential and will not be recorded or shared without consent unless legally required.

 

9. User Conduct

 

You agree not to:

• Use the website or Services for unlawful purposes

• Upload harmful code, malware, or interfere with the operation of the website

• Harass, threaten, or abuse Inaya Wellness staff or other users

 

Violation of these rules may result in termination of access without refund.

 

10. Limitation of Liability

 

To the maximum extent permitted by law, Inaya Wellness and its founder, Jimit Shah, are not liable for any indirect, incidental, consequential, or punitive damages arising from the use of our Services. Results are not guaranteed and vary from person to person.

 

11. Indemnification

 

You agree to indemnify, defend, and hold harmless Inaya Wellness, its team, affiliates, and partners from any claims, liabilities, costs, and expenses arising from your use of our Services or breach of these Terms.

 

12. Modifications to the Terms

 

Inaya Wellness reserves the right to update or change these Terms at any time. Continued use of the Services after changes constitutes acceptance of the revised Terms.

 

13. Governing Law

 

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
